The U.S. Department of Labor (USDOL) Wage & Hour Division published Field Assistance Bulletin (FAB) No. 2024-1, Artificial Intelligence and Automated Systems in the Workplace Under the Fair Labor Standards Act and Other Federal Labor Standards, which emphasizes employers’ responsible human oversight of the use of AI to maintain compliance, regardless of the specific technologies and systems used, with respect to hours worked, calculation of wages, Family Medical and Leave Act (FMLA), nursing employee protections (the PUMP Act), Employee Polygraph Protection Act (EPPA), and prohibited retaliation.
