The U.S. Department of Labor (USDOL) has issued a Final Rule updating the Davis-Bacon Act to better reflect the current needs of construction industry workers on federal projects. The rule is effective October 23, 2023. Among the changes:
Instead of the current weighted average method, the new rule reverts to the pre-1982 3-step process for determining a prevailing wage, in which the prevailing wage will be based on the wage paid to at least 30% of workers of a particular classification in the local community
New recordkeeping requirements for employers include maintaining payroll records, employee phone numbers and email addresses for at least three years after the work is completed.
