EEO-1 Expanded Pay Data Rule Halted by OMB

On August 29, 2017, the federal Office of Management and Budget (OMB) halted the expanded equal pay data collection finalized by the Equal Employment Opportunity Commission last year. The rule would have required employers with 100 or more employees, and federal contractors with 50 or more employees, to report expanded pay data by gender, race and ethnicity using a revised EEO-1 starting with the 2017 report. The OMB will review the rule to determine whether it meets the standards of the Paperwork Reduction Act (PRA), as well as issues of utility, burdensomeness, and confidentiality.

Despite this stay, employers must still comply with previously instituted EEO-1 reporting requirements by the 2017 report filing date of March 31, 2018. The EEOC will be issuing guidance to employers on technical compliance questions.
