Amendments to HRS Section 386-123, Workers’ Compensation Law
On July 10, 2017, HB 208 was signed into law as Act 135, amending Section 386-123, Hawaii Revised Statutes, as follows:
Shortens the default period for employers failing to provide employees with workers’ compensation coverage from 30 days to 14 days; employers in default may be enjoined from continuing to do business by the applicable circuit court.
Authorizes the Department of Labor and Industrial Relations (DLIR) to issue an order of wage payment violation to an employer, enforceable by court order.
Adds fines of not less than $500 or $100 for each violation, whichever is greater, of wage and hour laws.
