Amendments to HRS Section 386-123, Workers’ Compensation Law
On July 10, 2017, HB 208 was signed into law as Act 135, amending Section 386-123, Hawaii Revised Statutes, as follows:
- Shortens the default period for employers failing to provide employees with workers’ compensation coverage from 30 days to 14 days; employers in default may be enjoined from continuing to do business by the applicable circuit court.
- Authorizes the Department of Labor and Industrial Relations (DLIR) to issue an order of wage payment violation to an employer, enforceable by court order.
- Adds fines of not less than $500 or $100 for each violation, whichever is greater, of wage and hour laws.
