DOL Proposes 90-Day Delay for New Disability Claims Procedure

On October 12, 2017, the Department of Labor (DOL) published a proposed rule for a 90-day delay of new claims procedures, applicable to ERISA-covered employee benefit plans that provide disability benefits. The 90-day period allows for additional public comment. Currently scheduled to apply to claims filed on or after January 1, 2018, the rule if finalized will apply to claims filed on or after April 1, 2018.
