OFCCP Directives Clarify Evaluations and Investigations Policies and Procedures

The Office of Federal Contract Compliance Programs (OFCCP) has released three policy directives to help clarify how it conducts evaluations and investigations. They include:

Early Resolution Procedures (ERP): Provides a mechanism for the agency and contractors to reduce the length of compliance evaluations; in addition, ERP allows the agency and contractors with multiple establishments to cooperatively develop corporate-wide compliance.

Opinion Letters and Help Desk: Questions submitted by OFCCP stakeholders (contractors, their employees and job applicants, and the public) about agency laws and regulations by phone or email to its Help Desk may be posted online, with answers, as Frequently Asked Questions (FAQs), searchable online. Some inquiries may also be published as anonymous Opinion Letters, with the requester’s consent.

Evaluation Procedures: Evaluation Procedures: Compliance evaluations will follow the Federal Contract Compliance Manual. This directive rescinds the Active Case Enforcement (ACE) Procedures.
