Federal Judges Block Healthcare Workers National Vaccine Mandate

Update: On January 13, 2022, the U.S. Supreme Court ruled that the CMS emergency regulation could be enforced nationwide. See our post for more information. 

Federal judges have blocked a national vaccine mandate for healthcare workers set to take effect January 6, 2022, A federal judge in Missouri issued a preliminary injunction on November 29 against the Centers for Medicaid and Medicare Services (CMS) mandate that required all healthcare workers in facilities that accept Medicare/Medicaid to be fully vaccinated by January 4, 2022. The injunction applied in 10 states that challenged the rule. On November 30, a federal judge in Louisiana issued a preliminary injunction against the vaccine mandate applicable to all remaining states. Together, the rulings block the CMS mandate nationwide until further notice. CMS has appealed both decisions; see its FAQs on the mandate.
