USDOL Self-Audit Programs at OSHA, EBSA and VETS
The U.S. Department of Labor (USDOL) has launched or re-launched self-audit programs at the Occupational Safety and Health Administration (OSHA), the Employee Benefits Security Administration (EBSA) and the Veterans’ Employment and Training Service (VETS). These programs allow employers to voluntarily assess compliance with federal labor law.
- OSHA: As previously covered, the USDOL has re-launched the Payroll Audit Independent Determination (PAID) self-audit program to self-identify and resolve Family & Medical Leave Act (FMLA) and Fair Labor Standards Act (FLSA) issues.
- EBSA: The EBSA offers two self-correction programs for fiduciaries and benefits plan administrators: the Voluntary Fiduciary Correction Program, which allows employers and plan officials to voluntarily correct violations of the Employee Retirement Income Security Act (ERISA); and the Delinquent Filer Voluntary Compliance Program, which offers incentives to late filers of ERISA’s annual reporting requirements, including paying lower penalties.
- VETS: The Veterans’ Employment and Training Service has launched a new program called Support and Assistance to Leaders in USERRA Training and Employment, or SALUTE. This program helps employers proactively review their policies and practices under USERRA (Uniformed Services Employment and Reemployment Rights Act).
