On May 20, 2025, the Equal Employment Opportunity Commission (EEOC) announced the opening of its 2024 EEO-1 Component 1 Data Collection; deadline to file is June 24, 2025. The EEO-1 (Employer Information Report) is an annual collection of workforce demographic data, including data by job category and sex and race or ethnicity, to be submitted by all private sector employers with 100 or more employees, as well as federal contractors with 50 or more employees meeting certain criteria. The collection period will not be extended beyond June 24.
Beginning with the 2024 EEO-1 Component 1 data collection, all communication sent to filers will be electronic. No notifications will be sent to filers via postal mail. The report can be filed via the 2024 EEO-1 Component 1 Data Collection page. From this site, filers can download the EEO-1 instruction booklet, fact sheets, as well as FAQs, data file specifications, job classifications, and more.
The site also includes a message from EEOC Acting Chair Andrea Lucas warning employers that they may not take “any employment actions based on, or motivated in whole or in part by, employee’s race/ethnicity or sex, or other protected characteristics,” and that “there is no ‘diversity’ exception to Title VII’s requirements.” Referencing the Executive Order “Restoring Equality of Opportunity and Meritocracy,” Lucas said all agencies including the EEOC will deprioritize “disparate impact” enforcement. Lucas noted that “the fact that a neutral employment policy or practice has an unequal outcome on employees of a particular race or sex – that is, has a ‘disparate impact’ based on race or sex – does not justify your company or organization treating any of your employees differently based on their race or sex.”
